You represent and warrant that:

  • You own or control all rights necessary to submit the content.

  • The content does not infringe upon the rights of any third party.

  • The content does not violate any applicable law.

Unless otherwise stated in a separate written agreement, ownership of submitted manuscripts remains with the submitting author.

5. User Content

If you submit comments, feedback, testimonials, reviews, or other content through the Site, you grant Crimson Crow Press a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and publish such content in connection with operating and promoting the Site and our business.

We reserve the right, but not the obligation, to remove content at our discretion.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRIMSON CROW PRESS, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Any legal action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Contra Costa County, California, and you consent to the jurisdiction of such courts.
